EDUCATION

Joseph G. Nogay attended West Virginia University, where he graduated cum laude with a bachelor of science in accounting in 1981. While in college, Mr. Nogay was a member of several academic honoraries. Mr. Nogay received his Juris Doctor from West Virginia University’s College of Law in 1984, where he was selected to The Order of Barristers, a national advocacy honorary. While in law school, Mr. Nogay was a member of West Virginia’s College of Law’s Moot Court Board, and was a member of their National Moot Court Board Team.

BAR ADMISSION

He is licensed to practice law in West Virginia, Ohio and Pennsylvania, and is admitted to practice before the Supreme Courts of those states as well as federal district and appeals courts such as the Fourth Circuit Court of Appeals. He is a member of the bar associations of West Virginia, Ohio, and Pennsylvania, and is a member of the American Association for Justice and a member of the West Virginia Association for Justice.

PRACTICE AREAS

Mr. Nogay’s practice is unique in that he has successfully represented individuals, energy companies, health care groups and physicians, and Fortune 500 corporations in litigation, as both plaintiffs and defendants. These diverse representations have enabled Mr. Nogay to fully understand the litigation process so as to best serve the interests of his clients. Mr. Nogay has achieved tens of millions of dollars in verdicts or settlements for individuals and corporations in various types of litigation. Those areas where Mr. Nogay has successfully litigated verdicts and settlements for his clients include personal injury, product liability, medical malpractice and oil & gas litigation.

In addition to representing catastrophic personal injury victims, Mr. Nogay has also litigated product liability cases against multi-national companies and he has litigated cases involving major oil and gas leases and royalty payments, both for land owners and energy companies. Mr. Nogay has successfully litigated a seminal decision in the oil and gas industry concerning binding arbitration clauses in leases. (See, Heller v. TriEnergy, Inc., 877 F. Supp. 2d 414 (USDC NDWV, 2012)). That federal court decision has been widely reported.

His law practice is limited, primarily, to litigation, both personal injury and corporate, and he has litigated cases in state courts in West Virginia, Ohio, Pennsylvania and New Mexico, and in federal district and appeals courts of several different states. Mr. Nogay was selected for membership into the National Trial Lawyers Top 100 Lawyers’, an organization that recognizes the best civil litigators in the United States. Mr. Nogay has been accepted into membership in the elite Million Dollar Advocates Forum for his courtroom successes. The Million Dollar Advocates Forum is comprised of the top trial lawyers in America and accepts less than 1% of all lawyers into its membership. Mr. Nogay has attained a peer-reviewed “Very High Rating in Both Legal Ability and Ethical Standards” from Martindale-Hubbell.

Mr. Nogay has served as City Solicitor for Chester, West Virginia, and as Vice Chairman of the West Virginia State Bar’s Real Estate Committee, and has served on several charitable, civic, professional, and bank boards.

PERSONAL AND FAMILY BACKGROUND

Mr. Nogay was born in Weirton. He is married to Cathryn Samples Nogay, and they have two sons, Evan and Camden, both of whom graduated from Dartmouth. Evan is a commercial litigation lawyer in Chicago and Camden works in private equity in Los Angeles. Mr. Nogay and his wife have residences in Weirton, West Virginia, and Pinehurst, North Carolina, where Mr. Nogay is a member of the Pinehurst Country Club.
